The position of the hitch is also important. the more it's above or below the ideal position for the trailer, the more unstable the trailer is.. Above seems to be worse than below (it causes the trailer wheels to have some toe-out).

I think the $11.6M jury award was assinine when the pilot's son was speeding in the rain -and- the pilot grabbed the wheel (of a top-heavy Ford Explorer, no less) during the emergency. Whadda maroon! The wife's paraplegia is definitely unfortunate, but wasn't the fault of U-Haul. Effin' courts...
High downhill speed is the worst thing you can do with a trailer. I reinforced my skills when I brought home this little 13' travel trailer last month. Anything over 45 gave me horrible sway, and it's a tiny gutted trailer! Air pressure at max in both vehicles' tires and a properly sized hitch ball are also crucial. Tongue weight adds to the safety of the braking of the combo, too.
Anything largish trailer I rent from now on will have brakes, though. I do NOT like squirrely vehicles.
