Not "required". Requested by the vendor. Requested by the dealer. The LAW does not require it.

Here's the simple test for today:

Does the vendor require the dealer to have a license? Does the vendor do the paperwork that goes with a license transfer. If the answer to both of those is YES, then the dealer better do likewise when disposing of the materials to a customer. If the answer is NO, the dealer can't start the paperwork trail...

Not true. At ANY time a dealer (or a user or a manufacturer) can "log out" a previously "logged in" material if it is exempt. One such exemption is 27 CFR 555.141-a-8, yet another is 27 CFR 555.141-a-7, and there are many more as well.

The supporting evidence for this statement is not my word alone but an ATF directive as follows:

See

page 10 (page 62 of the "Orange Book")

  1. Who must meet storage requirements? All persons who store explosive materials must store them in conformity with the provisions of Subpart K of the regulations, unless the person or the materials are exempt from regulation. [18 U.S.C. 842(j), 845; 27 CFR 55.29, 55.141, 55.164,
55.201(a)]

Note the reference to 55.141.

Errortech mislogs these materials all the time. It is time for those unfortunate enough to be lisencees and errortech customers to "log out" propellant materials in FULL COMPLIANCE with the LAW.

This should be in the FAQ.
