Well, I don't know enough about the details of the accident, and fortunately I've never been on either side of a lawsuit, but clearly you have to assert some sort of negligence on the part of the defendant. However, just because someone claims negligence doesn't mean that it actually occurred.

Oh, I'm all too aware of that. Our legal system needs a swift kick in the butt, and so does our society. We need to get over this "everyone else is to blame for my mistakes" mentality and get back to personal responsibility.
