Wouldn't this be a good time for negotiations with the BATFE?

You aren't.

I believe you're referring to this passage:

- - --- - - In any event, the November 18, 1986 approvals issued to ACS-Reaction Labs were no longer valid after October 1, 1993, the effective date of the new classification system for explosives adopted in RSPA s final rule in docket No. HM-181, 55 Fed. Reg. 52402 (Dec. 21, 1990), 56 Fed. Reg. 66125 (Dec. 20, 1991). As RSPA explained in the preamble to the December 20, 1991 final rule, at p. 66141, "for an explosive that had been approved under the old HMR [i.e., as a Class A, B, or C explosive], to be transported after October 1, 1993, it would have to be reclassified under the new regulations," in Divisions 1.1 through 1.6. - - --- - -

Now here we have one of those things that make you go "hmmm...", as this paragraph omits reference to the "Competent Authority Approval CA-861124" (dated November 28, 1986) issued to ACS, which appears already to be using the "new style" classifications, as it refers to the assigned shipping hazard category as "UN Class: 1.3C" (based on the BOE testing report of July 14, 1986, which did use the old "class B" terminology).

Jerry,

Where's the ACS Reaction Labs EX document "that never expires"? The one that was at:

George, do You need a copy?

Dave Grayvis replied:

Hey Dave, all this time you've been defending Jerry, claiming that he is legal and criticising everyone who says otherwise. Now it's been proven that Jerry wasn't legal, and instead of admitting you were wrong, you bash the guy who supplied the proof.

Besides, how many times has Jerry insisted that he wants to be a test case? Here's his chance.

In fact, that's the main reason Jerry's in this mess. He constantly _dares_ people to prove him wrong. Then when they do, he (and you) blame them.

Prove it.

Prove that too.

No. Why would it be valuable? It doesn't help anyone who doesn't have a LEUP. It doesn't help in the fight against the ATF and government over-regulation of a benign hobby.

"So if most folks are paying excessive taxes to King George, why should the colonies rebel?"

Come on, Shock! You surely you have more spine than that.

Just because someone is forced to do something doesn't mean they are "comfortable" doing it.

Dave, It's funny how you've taken this latest turn. You've said all along that Jerry was legal, and that all any body had to do was talk their way out of fines with the PAD defense. Now, that he is facing fines, you don't address that, but start blaming Fred?

Remember:

Jerry mailed the east coast boys some rocket motors, probably labeled as airplane parts or something. Jerry asked Fred to intervene on his behalf, and try to get DOT to "comply with Jerry" (snicker, giggle). Fred asked around, and was soon himself, under the scrutiny of the FEDS. THEY started asking questions, and the more Fred learned, the more he realized he couldn't vouch for Jerry, because Jerry wasn't telling the truth. Fred didn't rat out Jerry. Jerry used Fred to try to back door a federal agency. Fred has a right to be a little irritated with Jerry.

Remember:

Jerry lied to the Feds about the document's validity. He lied to us and the Feds about USR. He shipped rocket motors to minors via regular mail years ago. (maybe he's been on the Feds radar since then?) He tried to con Fred into backdooring a Federal agency, putting Fred in a bind. (ever have a freind ask you to lie for him? How did that make you feel, Dave?) He then, after he had alerted the Feds to himself, sent rocket motors to a kid to shill for him.

and you blame Fred for Jerry's mishaps?

If Jerry got caught for speeding, would you blame all the other drivers for making him stand out by obeying the speed limit?

steve

What "latest turn"? Lack of tolerance for people (including, especially, anon-trolls) who rejoice at reports of fellow rocketeers being given trouble by the government? That's nothing new for me!

Someone draws a penalty, from an agency that seems to view the imposition of penalties as such a routine matter that it sets up a website to receive payments via credit card - the IRS doesn't even make it that easy to pay _income taxes_, for heaven's sake - and you (and the anon-trolls) expect us all to turn on him as if he'd been convicted of baby-torturing or something?

-dave w

Dave W..

It's not "anon-trolls" and it's not a "fellow rockeer(s)".

It's because it's Skippy..

It's all the folks that have been around for years, and listened to Skippy spout about how he was "legal", how he did/didn't own USR (and he now admits that there is no "USR"), how NAR/TRA did him wrong because they required VALID paperwork, how he'd take anyone to court, how he is the father of HPR, etc., etc., etc...

It's the folks that remember when the ROL forums got shutdown for an extended period, as the sysop was tired of trying to get Skippy to conform to the rules (he still can't post there)(notice I said "forums" and not "conferencing").

It's the folks that have watched was appears to be Skippy's disregard of all rules that he didn't make over the years!

He's not a "fellow rocketeer".. If he was, he would have gotten his motors certified! Instead he blames TMT and S&T, DOT, the FAA (in the case of his suspension" from TRA), and just about anyone else who doesn't view him as "the expert" in everything rocket related!

Well, finally he got caught. Shipped 200+ lbs of motors to a vendor, with bogus paperwork. That vendor then had a bunch of stuff which was not certified by NAR/TRA (the vendor must have known this in advance), but which he in turn couldn't ship to customers (legally), and couldn't even ship back to Skippy (legally). Yet, I'd think that Skippy was looking for payment.

I won't call the vendor a "snitch" as if the shipping issues had not been addressed, he's have had to pay for 200+ lbs of motors that he could do little or noting with!

IMHO, supporting the "vendor" in this case is "supporting a rocketeer", as he's looking out for his business and the hobby!

Skippy just finally got stuck in his own peanut butter!

With your continued backing of Skippy, I'll bet that you still also believe Nixon when he said "I am not a Crook" and Clinton when he said "I did not have sex with that woman"! If O.J. sold rocket motors, how would you feel about him?

And BTW "the IRS doesn't even make it that easy to pay _income taxes_, for heaven's sake ".

Guess you don't pay taxes or never done electronic filing! Yes, it IS that easy!

I see... to you it's all really a question of whether or not one is "properly anti-Jerry"?

Why don't you just write me off as "improper" then?

-dave w

When (1998) the BATFE said they were going to create a new hobbiest permit, no permit was required for any of the activities allowed by the new limited permit.

So just how does a permit for only intrastate use satisfy a promise to create a new permit that HAD to be for interstate use?

Darn glad that you take one line out of context! A True Skippy cultist!

Here's one line - "It's because it's Skippy and he's shown many over the years to only be interested in Skippy, not the hobby".

Think that sums up the part that you seem to have missed!

Seems you ignored my question about Nixon, Clinton, and O.J. too!

That corner seems to be getting smaller, yet you keep painting!

First off, nobody has given jerry trouble, except jerry himself.

Um, dave, you can in fact pay your taxes with a credit card.

Type slow for the guy. He still thinks Skippy is beneficial to rocketry.

"We"? Multiple Personality Syndrome, or a mouse in your pocket?

-dave w

It's also totally useless to rocket hobbyists (too restrictive, can't be used across state lines, doesn't eliminate the storage requirements) and appears to have been created completely without taking any rocketry issues into consideration.
