Yes I agree, but in the post that discussed Maine's requirements on buried lines did not mention buried tanks. Only buried lines were described. Lines are often buried from tanks located in garages, or in the basement it self, and this would generally put the tank above the burner.

Maine also has regulations prohibiting the use of fuel lines buried in a slab, unless they are carried within a separate shield. When I had my house built in
1983, it was common practice to bury the copper oil line in or under the slab. Within fifteen years it not only became illegal to do so, but the state required that any buried lines be re-routed above the slab. You'd think that a practice so dangerous as to require retrofitting would have at least been a cause for concern only a few years before, wouldn't you?
