Distilled water, maybe. Tap water, generally no - includes source impurities, dissolved mineral salts, chemicals added during processing. pH may be slightly acid or alkaline.

I was looking at the list of recalled toys in a train shop yeaterday. Almost all were red items (e.g., James). Lead oxide is normally red. It is (or was) used to paint the Forth Rail Bridge.

Did Mattel specify "lead" paint? If so, prosecute!

I'm guessing here, but in all probability Mattel set the price without specifying the type of paint and the Chinese were left to work out how to meet the order. Its up to the ordering company to specify to suit the markets they intend to resell in. After all, we can guess that Mattel aren't going to give the Chinese manufacturers the details of their markets.
