LEUP and NYS Law

Can someone throw some light onto the subject of LEUP and Storage in Western New York?

I'm looking to start the process so I can fly/store Level 1 stuff this coming year.

First thing that you need to do is check with your local fire marshal. Everything depends on him/her. You will need a letter from him/her giving permission for storage. The ATF requires this now before they will give you a LEUP. In my state, Ohio, you ALSO need a storage permit from the state fire marshal.

Hi Tom.

most Level 1 stuff is currently Easy Access and can be purchased without a leup, and no need for storage.

I am now prepared for an r.m.r debate on easy access ;-)

Thomas: NY State is an ICC/IFC state which incorporates the NFPA 1122/1125/1127 via the IFC (International Fire Code) Chapter 33/34(depending on issue year).

Therefore if NY State considerd APCP an explosive as does the BATYFE, it would eb wise to find out from your local fire district whether or not you will require any form of permit from the NY State Fire Marshall to be legit.

Les,

That is part about the state fire marshall requiring a permit in OH is untrue. A few friends of mine were recently sent a letter from the state fire marshall saying that a permit was needed when they renewed their LEUP's. They contacted the fire marsharll's office based on a clause in the letter that says that model rockets and motors were EXEMPT. The magine permit applies to FIREWORKS. The fire marshalls office said they would get back to them and of course they never did.
