Is it legal to tape something off the air and sell it on ebay?

It is my understanding that it is NOT legal to do so.

It is also my understanding that it is NOT legal to hand out copies of said recording, either, even if at a loss.

This has been a major issue with several types media companies, with every type of media, on every type of meduim, creating a situation that needs mediation, immediately. (Pardon my mediocre fun with words.)

if its not legal why hasnt ebay deleted the listing? last time I heard they dont allow copyrighted materials on their site. But my understanding is that those commercials are copyrighted so taping them and selling them is very illegal. Thats like copying a CD then selling them on ebay...

I believe commercials are not copyrighted to ENCOURAGE copying.
