eBay: interesting behaviour by seller

Below is a copy of an email exchange that took place earlier. It is unedited, save for the fact that I blotted out the personal data of another buyer who is not directly involved. Conclusions are left to the reader

Good evening Rob, thank you for your e-mail however I am afraid that I disagree with what you have written. I bought that kit earlier this year on Ebay and have done nothing to it at all - it is in the same sealed bag and has not been touched by me but has been stored ever snce I bought it. In addition to this I cannot be held responsible if the person who bought a similar kit does not want to contact you but as I stated earlier, as he lives in xxxx it may take a while for the kit to get to him. I am sorry but I am not willing to enter into any further correspondence relating to this item and if necessary will be forced to take legal action against you if you libel me again by suggesting misrepresentation - I have very good feedback on Ebay and am proud of it as I am amateur who always strives to offer a professional service.

Rob, On first reading , the quick knee jerk ' I'm gonna get a lawyer after you' seems a bit of overkill on his part and a give-away that all might not be right in Denmark.

No luck getting in touch with the other buyer yet? It would be interesting to hear what was in the box HE got.

That's what I thought. Until then an honest mistake seemed at least as likely. After all, he might very well have bought a boxload of kits at a garage sale or something, and simply have gone by the labels. If he'd taken the "OK, I goofed" line, all might still have turned out well.

He got in touch with me after getting the kit. The seller was entirely correct about one thing at least: both kits were in exactly the same condition. I'm not going to make statements for the other buyer, but I don't think it would be appropriate to describe him as overjoyed. I forwarded the instructions Jonathan mailed me to him, and he had something to cannibalise parts from, so at least he should be able to build it now.
