the way I am doing it is very very unlikely to invoke the wrath of discovery channel. they will probably simply "not answer" my question. and "look" the other way at what I am doing. and then step in if I cross some line etc..

This is usually how they do this kind of thing when it can not financially hurt them in anyway IE they are not selling it etc..)

it also not something uber popular like monster garage. they would probably come down on anyone copying that regardless of intent.

Grrrr DMCA. I personally do not recognize the DMCA as law. I refuse to accept it.

I will not "actively" and "publicly" defy it (I did not before and see no reason to now) but I do not recognize it as law.

Second I am doing something that I consider gray legal. the trick is does discovery feel the same way ?

I have no problem doing this in public. if they ask me to stop I will. in fact I have done nothing illegal (yet)

EXACTLY. if they plan to look the other way but monitor how far I take it will they say nothing.

BUT by having "asked" I have helped guide their responces to some extent.

it would be hard to come down hard on me considering that I asked first. if they decided to put an end to it their is a nearly 100% chance they would simply ask me to stop officially in the form of a letter and end it their (assuming I complied which I would off course)

by ignoring me they are saying ok do it but be careful we have given you no legal rights yet so we can stop it anytime.

Now that is what confuses me so much.

if a mac 3 years old is still usable please explain to me how an equal or better performing pc of the same exact age is suddenly not useful anymore ?

do pc's magically become slower machines as they age ? my primary machine for 5 years was a Pentium 166mhz machine - I finally upgraded when I got heavy into larger image and video work.

being in the IT (Information Technology) for 22+ years, I can speak with some authority on this

your old PC will continue to be useful provided that the OS and software are not upgraded beyond that which was designed to perform well on that particular hardware

the problem lies in when you install the OS dujure, and the Office package that is made to run on it, which now has flying paperclips and talking text boxes ... expectedly the hardware may no longer be quite up to the task

the old addage applies, "If it ain't broke, don't fix it".

OTOH, if you want to get software support, they will invariably tell you to upgrade the OS, install a Service Pack, get the latest version of the application, and then call them back

even Sun Microsystems (one of my former employers) publishes an "End Of Life" schedule for both hardware and software. That's not tp say it won't still work, they just won't spend any resources keeping it working (unless you have a maintenance contract).

BTW, I have seen large financial services companies that have apps which will only run on a 10 year old OS, which they lost the source code and/or personnel with familiarity to support it, look desparately for a copy of that OS that we might perhaps have burined in our office drawer, given that it went out of production 5 years ago [e.g.; Sun OS 4.1)

the moral of the story is, if your apps perform well, you're old PC is just fine. If you want to use "modern" apps, get a new PC (it's cheaper in the long haul than upgrading), and get it with the latest OS and Office package pre-installed.

I've been saying this for years! I hate it when people tell me pc's are when the warranty is up. I have a 10+ year old cpq 486 deskpro that I swear just won't give up. It started it's life, now get this, as a Netware 3.x box serving 50+ users with out breaking a sweat. One time it was up for a solid 36 months! I still have it operational at home just so I can touch up my Netware 3.x skills.

btw, there's an excellent article in a recent pop science on how to rejuvenate 'old' pc's for current use.

A law is a law, period. If it's ridiculous, or stupid then they must work to change it. Personally, I think the laws governing possession, and usage of APCP are ridiculous and stupid, and I'm happy that I'm a part of the effort to change this.

Speeding is breaking the law. If you break the law, you assume the risks of being caught. That could be a warning, a ticket, or an arrest for vehicular homicide if you happen to pop someone while speeding.

No, but I assume the risks, and if caught will pay the penalty. Oddly enough, I got a ticket for just that in downtown Cleveland. Cost me $25 bucks. I had absolutely no defense, or reason for not using the crosswalk which was about 20 feet away. I pretty much use them all the time now, and if you examine the logic behind the law, it really does make pretty good sense.

If Chris wants to assume the risk of getting his butt tossed into jail for a few months, and, as BB put it, getting his bank account "bitch-slapped" then that's up to him. I'd rather not be called as an accessory for "recieving stolen property" if they decide to come down hard... which they're more than capable of.

The point I'm trying to make is that just because you think a law is ridiculous or stupid doesn't really give you some sort of a personal voucher for breaking it. If that were the case, then why have *any* law at *all*?
